The present conditions are concluded, in France, in the DOM-TOM, in Belgium, in Luxembourg, in Switzerland, in Canada and within the framework of a system of remote sale, between a cyberclient and the commercial site.

ARTICLE 1 - Acceptance of these general conditions

The fact that a customer completes the order form and confirms his order by carrying out the formalities required to pay the price, constitutes full acceptance of these general conditions of sale that he expressly declares to accept without reservation.


ARTICLE 2 - Order validation and contract confirmation
 

The information transmitted by the buyer when ordering commits the latter: in the event of an error in the wording of the recipient's contact details, Jolly Jane. cannot be held responsible for the impossibility in which it could be to deliver the ordered objects.

Any refusal to accept an order can be confirmed by return e-mail within 72 working hours at the latest. 

Jolly Jane. furthermore reserves the right not to record a payment and therefore not to confirm an order, in particular for financial or other security reasons.


ARTICLE 3 - Withdrawal-returns

The customer has the right to return his purchase at his expense within 14 days of receipt of the package. In the event of an exchange, the unworn product must be returned in its original packaging. Jolly Jane. will entitle you in this case to an exchange or a refund.

The transport costs are the responsibility of the customer. 

ARTICLE 5 - Price

The prices are printed in euros. The prices indicated next to the photos of the products are those in effect at the time of consultation and may be modified subsequently, without notice. They do not include the cost of transport.
The total amount indicated in the order confirmation is the final price, expressed inclusive of all taxes, including French VAT and the price of transport according to the choice of delivery method made by the customer.
Any customs duties to be paid at destination are the responsibility of the customer.


ARTICLE 6 - Payment 

The price invoiced to the customer is the price indicated when confirming the order. The price of the order is payable in cash at the time of the order.
Payment is made by credit card.
 

Jolly Jane. uses secure credit card payment.

The bank card number, the validation date and figures of the  cryptogram are transmitted encrypted. Information concerning your card (number and validity date) does not pass through jollyjane.fr  This transaction takes place on the bank server.

ARTICLE 7 - Disputes 

This contract is subject to French law.
Jolly Jane. cannot be held responsible for any damage which could result from a misuse of the marketed products or from any modifications of the products resulting from the manufacturers.
The responsibility of Jolly Jane. will, in any event, be limited to the amount of the order.
In the event of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution.
Complaints or disputes will always be received with care and kindness. In the event of a dispute, the Paris Commercial Court has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.
Goods shipped will remain the property of Jolly Jane. until the last day of their payment in accordance with the term of law n ° 80-335 of May 12, 1980.


ARTICLE 8 - Guarantees 

The buyer takes advantage of the legal provisions regarding the guarantee against hidden defects. Excluded from this guarantee are the inappropriate use and storage of objects.


ARTICLE 9 - Confidentiality 

The nominative information requested for the purposes of distance selling are mandatory, they are essential for the processing of the order, delivery and invoicing.

Lack of information results in the customer's order not being taken into account.
In accordance with the "Informatique et Libertés" law of January 6, 1978, the processing of personal information relating to customers has been declared to the National Commission for Computing and Liberties or CNIL.

ARTICLE 10 -  Shipping and delivery

The delivery address must not be a post office box: if this is the case, the order will not be taken into consideration.
Delivery is made either to the customer who placed the order, or to another person expressly specified by the customer.
Delivery times may vary depending on the destination. 
Any delays do not entitle the buyer to claim damages. 
The products always travel at the risk and peril of the recipient. 
When receiving the package, the customer must check the contents. He can only make reservations if the package is damaged and if its content does not comply with his order. 
Delivery costs are calculated in relation to its destination and the delivery method chosen. 
The transport and customs costs for the possible return of a product are the responsibility of the customer.
The products are only deliverable while stocks last. The customer will be notified if an ordered product is unavailable.
Are considered as force majeure relieving not to deliver, wars, riots, fires, strikes, accidents, fortuitous events and the impossibility of obtaining supplies.
Any product ordered but prohibited for import into the country of destination will not be delivered. It is up to each customer not to order products that may be prohibited for import into their country. If so, Jolly Jane. would not be held responsible for the rejection of the delivery by the authorities of the country of destination.

 
Preparation and delivery times: 

Jolly Jane. prepares orders as quickly as possible, usually within 24 hours (working days). The packages are then sent by post from Monday to Friday (except holidays). The preparation time is 48 hours maximum (except during sales).
